TVFC Agreement
As a member of the Trump Victory Finance Committee, I understand and agree that:
- I am, and at all times will be, acting solely in a voluntary capacity and not as an agent of Trump Victory or any of its participating committees, Donald J. Trump for President, Inc., the Republican National Committee, or the state party participants.
- Any conduct deemed in the sole discretion of Trump Victory or either of its participating committees to be illegal, unethical, dishonest, or otherwise inappropriate will result in my immediate removal from the TVFC.
- All individuals I solicit must be U.S. citizens or have permanent resident status (i.e.Green Card) and must contribute their own personal funds.
- I will not knowingly solicit or accept any contributions from corporations, foreign nationals, or federal government contractors.
- I will not knowingly accept a contribution from someone who received the funds from another person or entity or who will be reimbursed by another person or entity.
- I will not accept or forward any contribution for Trump Victory – all contributions must be sent by contributors directly to Trump Victory for processing.
- I read and understand the entirety of the contents of this TVFC Agreement, including the accompanying documents on Limits, Prohibited Contributions, and Guidelines/Etiquette.
Limits
- Contributions to Trump Victory (“TV”) are not tax deductible and will be used in connection with federal elections. Federal law requires us to use best efforts to collect and report contributors’ names, mailing addresses, occupations, and employers. TV is a joint fundraising committee composed of Donald J. Trump for President, Inc. (“DJTP”) the Republican National Committee (“RNC”) and the official Republican state parties in Arizona, Colorado, Florida, Georgia, Iowa, Illinois, Kentucky, Louisiana, Maine, Michigan, Minnesota, Montana, Nevada, Nebraska, New Hampshire, New Mexico, New York, North Carolina, Ohio, Pennsylvania, Virginia, and Wisconsin.
- Contributions from individuals (multicandidate PACs in parentheses) will be allocated sequentially according to the following formula: (i) $2,800 ($5,000) to DJTP primary election account; (ii) $2,800 ($5,000) to DJTP general election account; (iii) $35,500 ($15,000) to the RNC Operating account; (iv) $106,500 ($45,000) to the RNC Headquarters account; (v) $106,500 ($45,000) to the RNC Legal Proceedings account; (vi) $10,000 ($5,000) to Ohio Republican Party State Central & Executive Committee; (vii) $10,000 ($5,000) to Republican Party of Florida; (viii) $10,000 ($5,000) to North Carolina Republican Party; (ix) $10,000 ($5,000) to Republican Federal Committee of Pennsylvania; (x) $10,000 ($5,000) to Michigan Republican Party; (xi) $10,000 ($5,000) to Georgia Republican Party, Inc.; (xii) $10,000 ($5,000) to Republican Party of Wisconsin; (xiii) $10,000 ($5,000) to Nebraska Republican Party; (xiv) $10,000 ($5,000) to Republican Party of Minnesota – Federal; (xv) $10,000 ($5,000) to Arizona Republican Party; (xvi) $10,000 ($5,000) to Nevada Republican Central Committee; (xvii) $10,000 ($5,000) to Republican Party of Iowa; (xviii) $10,000 ($5,000) to New Hampshire Republican State Committee; (xix) $10,000 ($5,000) to Maine Republican Party; (xx) $10,000 ($5,000) to NY Republican Federal Campaign Committee; (xxi) $10,000 ($5,000) to Illinois Republican Party – Federal; (xxii) $10,000 ($5,000) to Republican Campaign Committee of New Mexico; (xxiii) $10,000 ($5,000) to Colorado Republican Committee; (xxiv) $10,000 ($5,000) to Republican Party of Virginia Inc.; (xxv) $10,000 ($5,000) to Republican Party of Kentucky; (xxvi) $10,000 ($5,000) to Montana Republican State Central Committee; (xxvii) $10,000 ($5,000) to Republican Party of Louisiana; and (xxviii) the remainder, up to $106,500 ($45,000), to the RNC Convention account.
- Notwithstanding this allocation formula, a contributor may designate a contribution for a specific participant or participants. In addition, the allocation formula may change if any contribution would exceed applicable contribution limit.
- Contributions must: (i) be made only by U.S. citizens or permanent residents; (ii) not be made from the funds of a corporation, labor organization or national bank; and (iii) be the donor’s personal funds, not those of another person or entity.
The following types of contributions are not allowed, exceptions are noted.
- Foreign nationals
- Exception: Lawfully permitted United States residency (i.e. Green Card) and are living in the US when contribution is made.
- Corporations
- Checks drawn from a corporate account or transactions using a corporate credit card
- Exception: Contributions from limited liability companies (LLC) may be accepted if the LLC is treated as a partnership for federal income tax purposes. Please consult Trump Victory before accepting these types of contributions.
- Partnerships
- Exception: Allowed to contribute $2,800 per election, as long as neither partner is incorporated.
- Must indicate how much of the contribution is to be allocated among the partners.
- Each partner’s contribution counts toward the individual’s federal limit per election.
- Individuals with government contracts
- Exception: Employees of government contractors may contribute with their own personal funds.
- Exception: PACs of government contractors are allowed to contribute.
- Banks
- Exception: Bank PACs are allowed to contribute.
Prohibited Contributions
- Labor unions
- Exception: Labor union PACs are allowed to contribute.
- Contributions in the name of another person
- No contributions are to be accepted from someone that has received the funds from another person.
- It does not matter if the funds are advanced or are being reimbursed.
- This prohibition is strictly enforced by the Department of Justice and any person or entity is subject to severe criminal liability if it is discovered these types of contributions have been made.
- Cash
- In the interest of liability, please under no circumstances accept or handle contributions made in cash.
The following activities are not allowed.
- Using corporate resources or facilities to raise funds for federal candidates. FEC regulations prohibit such activity unless the campaign pays the corporation fair market value in advance.
- Directing subordinates to assist you in your fundraising and/or asking them to contribute their own personal funds in the workplace.
- It is a crime to promise federal positions in exchange for contributions.
- It is a crime to solicit and/or accept campaign contributions while on federal government property.
FEC Rules for Volunteer Activities
- The value of any personal services you provide to the campaign as a nun compensated volunteer is not considered a contribution under FEC law and does not count toward your individual $2,800 limit.
- An individual may use their home for activities benefitting a candidate. The maximum amount an individual may spend on an in-home fundraising event is $1,000 per election. For couples the maximum that may be spent is $2,000 per election. Any amount over the $1,000/$2,000 threshold counts as an in-kind contribution and is attributed to the individual’s $2,800 per election limit
Guidelines/Etiquette
Please do not:
- Open a bank account or deposit checks into your personal account. This is a federal crime.
- All checks must be sent to Trump Victory within 10 days of being received.
- It is preferred that all checks are sent directly to Trump Victory from the contributor.
- Commit Trump Victory to pay any expense without the prior approval of the appropriate individual within Trump Victory.
- Any personal funds used to pay for campaign supplies counts as an in-kind contribution and must be reported towards an individual’s $2,800 per election limit.
- Say or do anything that could be interpreted as threatening or coercing to anyone under your supervision to contribute. This includes suggesting professional rewards.
- This is a federal crime.
- Reimburse someone for contributing, or suggest that their employer will compensate them for the contribution.
- This is strictly enforced by the Department of Justice.
- Use corporate stationery for any campaign activity, especially fundraising.
- The use of corporate stationery is considered a corporate contribution, which is illegal.
- Promote any event as a Trump Victory or Donald J. Trump for President fundraising event without prior approval of the appropriate individual within Trump Victory.
- Use any Trump Victory or Donald J. Trump for President trademarks, logos, or other branding in any form without prior approval of the appropriate individual within Trump Victory.
